Privacy and Cookies Policy

 

§ 1․ Definitions

The words used in this Privacy and Cookies Policy shall be construed as follows:

RCM - RCM Sp․ z o․o․ with its registered office at ul․Graniczna 3 Niedrzwica 19-500 Gołdap (Poland), entered in the Register of Companies kept by the National Court Register kept by the District Court in Olsztyn, with the National Court Register Department keeping the registration files under KRS number: 0000642734, NIP: 8471616578, REGON: 365668809

Website – the website belonging to RCM, located at www.rcm-trailers.com.

Services – all services provided electronically to Users by RCM based on the present Privacy Policy

User – any natural person, legal entity, entity with no legal personality or entity with legal capacity who makes use of certain functionalities of the Website and the Services․

Personal Data – the information collected during one’s registration on the Website that enables the identification of a given natural person, processed by the Website to the extent necessary for establishing contact with the User and enabling the User to use certain functionalities of the Website․

Electronic address - a denotation of an ICT system enabling communication by electronic means, in particular an electronic mail (email) address․

Registration form – a form filled in by the User that allows the User to use certain  functionalities of the Website․

Commercial information – any information meant to promote the services or image of RCM directly or indirectly, excluding information that enables communication by way of electronic means of communication with a specific person and information on services not serving the commercial outcome desired by RCM․

Cookies – brief text files in which the servers of the RCM Website store information on the hard drive of the computer used by the User․ The information stored in a “cookie” file may be read by the RCM Website server when reconnecting from that computer, but it may also be read by other servers or other Internet users․

IP address – an individual number possessed by every computer connected to a computer network

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation)․

 

§ 2․ General provisions

  1. The main purpose of the Website is to enable the use of the information and materials provided thereon, as well as to help interested Users contact us by e-mail and by telephone in response to their queries․
  2. The use of the Website may only occur under the terms of and to the extent indicated in the present Privacy Policy․
  3. Any and all intellectual property rights to the entirety as well as any part of the Website, including the materials and information contained thereon, in particular texts, navigation solutions, presented content selection and layout, word and graphic logotypes, interactive applications, audiovisual materials, material compilations, photographs, polls, forms, templates and studies, constitute the property of the Website, excluding those which constitute separate property of other manufacturers, distributors and service providers, and are subject to legal protection․ The same applies to any and all materials that the Service makes available to Users electronically, in particular by email․ Modifying, copying, distributing, transmitting, displaying, uploading, reprinting, sub-licensing, creating collective works from the above-stated materials, as well as reposting and selling these materials is not allowed, except under appropriate authorisation granted by the RCM․ Modifying, copying, distributing, transmitting, displaying, uploading, reprinting, sub-licensing, creating collective works from the above-stated materials, as well as reposting and selling these materials is not allowed, except under appropriate authorisation granted by the RCM.
  4. RCM reserves the right to place advertising content on the Website pertaining to the services offered, as well as the goods and services of third parties, in forms used on the Internet․
  5. RCM places “cookie” files on Users’ devices in order to facilitate User navigation as well as the correct operation of the Website․ Cookies files (“cookies”) are brief text files stored by the RCM ICT system on the User’s ICT system (i․e․ on the hard drive in the computers of visitors to the Website’s pages), chiefly for the purpose of identifying Users on the Website and collecting general information pertaining to how the Website is used․
  6. RCM uses the following “cookies”:

  • “essential” – for the proper functioning of the Website
  • “statistical” – to create statistics and analyses that help us understand how users interact with the Website, which enables us to optimise the Website’s content and functionalities․ For these types of files, we employ GOOGLE tools, i․e․ Google Analytics․ More information is found in Google Analytics’ security and privacy policy․
  • “marketing” – used for collecting information on what actions a User has performed on the Website, i․e․ what links they have clicked on and which Website pages they have visited․ Marketing cookies are collected when one completes a pop-up for contact and when they complete forms․

Cookies are also employed by third parties, e․g․ web portals such as Facebook, Instagram, YouTube, Linkedin, whose content may be posted on our Website․

The entities placing and accessing cookies on the User’s terminal device is RCM Sp․ z o․o․ as well as its Trusted Partners, i․e․ entities cooperating with RCM that provide automated marketing services and contact personalisation through a pop-up window․

Web browsers allow the use of cookies by default․

The user can prevent cookie storing at any time, using the settings of their Internet browser․ Detailed information on the ways and possibilities of cookie management is available in your browser settings․

Disabling cookies does not render using the Website impossible, but it may cause certain difficulties in that regard, and in some cases even make it impossible to use certain services provided within the framework of the Website․

The website uses two main types of cookie files – session and persistent․

Session cookies are temporary; they are stored until the User leaves the website (by accessing another page, logging out or closing their browser)․

Persistent cookies are stored on the User’s terminal equipment until they are deleted by the User or for the duration of their settings․

  1. In order to use the services of the Website, one must have a device enabling the use of Internet resources and an Internet resource browser capable of displaying web pages․
  2. Any User using the Website accepts the terms of this privacy policy.

 

§ 3․ Personal data collection and processing

In connection with its business activities, RCM collects and processes personal data pursuant to the relevant legislation, including in particular the GDPR, and the rules for processing data provided for therein

  1.   2. The Controller shall ensure the transparency of the data being processed, in particular always informing the User of the processing at the time of collection, including the purpose and legal grounds for the processing․ The Controller shall ensure that the data is only collected to the extent necessary for the stated purpose and is only processed for as long as necessary․

3.1 Purposes and legal grounds of processing

We use your data:

(a) based on expressed consent, in the case of:

  • performing marketing activities involving contact by email;
  • routing email notifications of interesting offers or content that may contain commercial information;
  • telemarketing activities aiming to promote the administrator’s activities;
  • expressing your wish to participate in future recruitment processes;
  • organising competitions aiming to promote the Administrator’s activities.

The data processed based on consent is processed until the consent is withdrawn,

(b) in the case of actions undertaken and aiming to execute the contract in order to:

  • business contacts
  • promotional activities
  • carrying out the ongoing recruitment processes
  • supply and sales contract conclusion and execution, order fulfilment
  • activation of the RCM equipment guarantee, processing of service requests and complaints․
  • post-sale service for all products and services offered by the company.

The data shall be processed until the contract’s termination or the end the period of limitation of claims arising from that contract, and may then be archived as required by applicable law․

(c) where the processing is necessary for the sake of legal compliance, e․g․ legislation pertaining to taxes, labour, social security and social protection․ The data retention period shall be in accordance with that stated in the specific provisions․

(d) where the processing of the data is a legitimate interest of the Controller in the case of:

  • assertion of and defence against claims,
  • responding to queries from clients and potential clients made through contact forms, the “Contact us” form, or any other form,
  • drawing up internal analyses of the market and customer satisfaction of the provided services,
  • need to ensure the safety of the persons and property of the Controller, through the use of video surveillance and control of access to the premises and grounds managed by the Controller; we store the recordings for a period no longer than three months, unless a given recording is evidence in proceedings,
  • exchanging contacts and business cards in order to initiate and create a network of business contacts,
  • direct marketing․

The data is processed until a legitimate objection to the processing is raised․

  1. Personal data is disclosed in connection with the activity to the following entities:

  • external entities, such as state authorities or other entities authorised on the grounds of specific legislation, the Polish Post, couriers, or banks in the event of the need to carry out settlements,
  • entities performing the following services for the Controller: operation of IT systems, marketing, legal, or recruitment support, distribution of marketing materials, organisation of training courses, insurance services. Such entities process data as instructed by the controller and on the basis of relevant agreements of entrustment.

  1. You have the right to demand access, rectification, erasure or restriction of processing by the Controller; a person providing their data has the right to object to the processing, to withdraw consent, and the right to transfer data. Any submitted applications shall be handled in accordance with the provisions of the GDPR. Written requests should be made to the Controller by letter or to contact@rcm-trailers.com. If the Controller is unable to identify the requestor based on the application made, the Controller shall request additional information from the applicant.
  2. Requests should be answered within 30 days of receipt. If an extension of this deadline is necessary, the Controller shall inform the applicant of the reasons for the delay. The response shall be provided by post, unless the request was made by email or a request for such a form of response was made.
  3. Anyone providing their data has the right to file a complaint with the President of the Data Protection Authority.
  4. The Controller processes data within the European Economic Area and, as a rule, does not envisage the transfer of the said data to third countries. In certain situations, data may be transferred to a third country where this is necessary for the performance of a contract between the Controller and the person whom the data regards, or between the Controller and a legal or natural person in the interest of the data subject, or when using the services.
  5. RCM Sp. z o.o. does not process personal data in an automated manner.

In connection with the User’s visit to a website where contact via telephone and email may be initiated, RCM is in possession of the Users’ IP addresses and information about the beginning, end and extent of use of the website, recorded in system logs. This information is used for statistical research and only pertains to which IP address used the website and when, and is not juxtaposed with any other personal data pertaining to the respective Users.

 

§ 4. Email correspondence

  1. Anyone who agrees to receive messages electronically accepts the rules contained in the present privacy policy.
  2. In order receive messages electronically, it is necessary to enter the following data on the relevant form: first or last name, email address.
  3. Providing the personal data referred to in paragraph 2 above is voluntary, but failure to do so will prevent the use of the electronic messaging.
  4. The data obtained in this way is added to the mailing list of RCM Service users. Data is always provided on a voluntary basis. Each registered User has the right to change or remove their data from our database at any time – in order to do so, please send an email on unsubscribing to email correspondence to RCM at: biuro@rcmc.pl.
  5. For the User’s convenience and information, RCM’s electronic correspondence may contain links to other sites. RCM does not assume any responsibility for the information posted thereon and the privacy policies applied.

 

§ 5. Facebook fanpage

The Controller processes the personal data of the Users of the RCM fanpage on Facebook in order to respond to messages that are directed via the respective FB functionalities, to make posts available to the user as an observer of our fanpage, and for marketing purposes consisting in providing the User with information on the services and the RCM company itself.

 

§ 6. Instagram account

The Controller processes the personal data of the user’s followers on Instagram for the purpose of responding to messages that are sent through the respective Instagram functionality, responding to Stories and comments, making posts available to the User as a follower of the RCM account, also for marketing purposes consisting in providing the User with information on the services and the RCM company itself.

 

§ 7. Linkedin account

The Controller processes the personal data of the User of the RCM account on Linkedin for the purpose of responding to messages that are sent through the respective Linkedin functionalities, for sharing posts with the user as an observer of the RCM account, and for marketing purposes consisting in providing the User with information on the services and the RCM company itself.

§ 8. YouTube account

The Controller processes the personal data of the User of the RCM account on YouTube for the purpose of responding to comments that are sent through the respective YouTube functionalities, for sharing videos with the user as an observer of the RCM account, and for marketing purposes consisting in providing the User with information on the services and the RCM company itself.

§ 9. Revision of the Privacy Policy

RCM reserves the right to amend the terms and conditions of using the Website by amending the Privacy Policy or introducing new terms and conditions, in particular in the cases described below:

  1. if amendments to legislation are made by the competent state authorities or the issuance of rulings that affect or may affect the rights and obligations of the parties resulting from the contents of the contract
  2. if changes are made to the technical conditions for providing the Services, including those related to technical or technological progress,
  3. if, due to technological progress or decisions by the authorities, changes are made to the communication rules of Internet or to the organisational rules of the Internet,
  4. as a result of events being effects of force majeure.

 

§ 10. Final provisions

  1. The privacy policy takes effect on the date of its publishing at rcm-trailers.pl.
